L3 Systems, Inc. Terms and Conditions

  • Shipping Information
    All shipments are F.O.B. L3 Systems, Inc., Redmond, WA, and shipping options with associated pricing will appear on order prior to payment. Items should ship by next business day. If for some reason this cannot be accomplished, the buyer will be notified about any delay and given the option of a complete refund.

    Shipping options are:

    • FedEx Ground - 3-5 business days
    • FedEx 3-Day Express Saver - 3 to 4 business days
    • FedEx 2-Day Express Saver - 2 business days
    • FedEx Standard Next-Day - 1 business day
    • FedEx Priority Next-Day - 1 business days, usually by 10:30 AM depending on location.
    Once shipped, title and all risk of loss shall pass to Purchaser upon L3 Systems, Inc.'s delivery to carrier. L3 Systems, Inc. shall not be liable for delays in delivery due to causes beyond its reasonable control, such as acts of God, acts or omissions of Purchaser, acts or omissions of Civil and Military Authority, fires, strikes, floods, wars (whether declared or undeclared) or any other cause beyond its reasonable control.All export duties and fees assessed on international sales shall be the obligation of the purchaser, and are to be paid by purchaser.
  • Refund Returns
    If a return for refund is desired, the customer should contact L3 Systems either via email or phone (see "contact us" link above). We will issue an RMA number and shipping instructions. The customer will ship the item back with the RMA number. Once we receive the returned item and it has been inspected, a refund will be issued. An email will be sent with a refund receipt indicating that the customer's account has been credited. A 15% restocking fee may be charged if no operational or performance issue is determined.
  • Warranty Returns
    If a warranty repair/replacement is desired, the customer should contact L3 Systems either via email or phone (see "contact us" link above). We will issue an RMA number and shipping instructions. The customer will ship the item back with the RMA number. Items sent back for warranty repair will be processed in accordance with warranty. All items returned to L3 Systems, Inc. for repair must be shipped prepaid, and all pertinent documentation must reflect L3 Systems, Inc.'s RMA (Return Material Authorization) number. The Purchaser will be responsible for all shipping charges on non-warranty repairs and/or items that have been mishandled and/or damaged by misuse, neglect, improper operation, accident or alteration, as determined by L3 Systems, Inc. International customers should note that because of the high costs associated with international air shipment and customs clearance, we request that you obtain specific shipping instructions directly from L3 Systems, Inc. before returning items for repair. Warranty repairs will be made at no charge. L3 Systems, Inc. will provide Purchaser with a written quotation of estimated cost for the repair of non-warranty items and/or for those items determined to have been mishandled and/or damaged by misuse, neglect, improper operation, accident or alternation, as determined by L3 Systems, Inc. The Purchaser will be required to provide a written purchase order to approve these charges before repairs can be made. For those items, which are deemed beyond economical repair, L3 Systems, Inc. will recommend the purchase of a new item.
  • Payment Terms for Orders on Account
    For customers with approved credit accounts, payment terms are net thirty (30) calendar days from date of shipment. Purchaser hereby agrees to submit reasonable financial information from time to time as required by L3 Systems, Inc. in the event Purchaser fails to make payments when due, or otherwise defaults hereunder, L3 Systems, Inc. may at its sole discretion and option, upon prior notice: (i) suspend credit and delay shipment until such terms are met; and/or (ii) alter the terms of payment; and/or (iii) cancel any order then outstanding and receive reimbursements for cancellation and/or (iv) bill back charges as applicable; and/or (v) pursue any other remedies available at law or equity. Purchaser shall pay a finance charge of 1 1/2% per month on all unpaid balances.

    Unless special arrangements are made, customers outside the United States are required to prepay orders, either by wire or credit card. Wire transfer orders must be a minimum of $750.00 USD, unless the customer agrees to pay a wire transfer fee.

  • Warranty
    L3 Systems guarantees this product to be free of defects in material and workmanship for 180 days from date of shipment to the end user. L3 Systems will repair or replace (at our option) products within the warranty period at no charge for parts and labor. Shipping costs (plus customs and duty, if any) to and from L3 Systems must be paid by the user. Damage or defect caused by accident, misuse or neglect is not covered. Damage or defect caused by shipping is excluded. L3 Systems shall not be liable for any consequential damage or losses from the use of, or inability to use its products. Any unauthorized repair or modification of the product voids the warranty. L3 Systems makes no other warranty, express or implied, nor have we authorized anyone to make representations to the contrary.
  • General
    In the event that any court of competent jurisdiction holds any provision contained herein to be invalid or unenforceable, such action shall not affect the remaining provisions, which shall remain in full force and effect. The failure of L3 Systems, Inc. to insist upon strict performance of any of the provisions contained herein shall in no way constitute a waiver by L3 Systems, Inc. of any subsequent breach or default of Purchaser. The delegation or assignment by Purchaser of all of its duties, obligations or rights hereunder without the prior written consent of L3 Systems, Inc. shall be void. All confirming purchase orders and payments must be addressed to: L3 Systems, Inc., Inc., P.O. 2954, Redmond, WA 98073.
  • Agreement
    This document contains the entire agreement of the parties. It supersedes any oral and any other written agreement between the parties prior to the date of this document. Neither party can alter, change, modify or substitute any other term or condition without first reducing same to writing and obtaining the written consent of the other party. L3 Systems, Inc. shall become bound under this or any other similar agreement only upon written acceptance hereof.
  • Limitation of Liability
    IN NO EVENT SHALL L3 Systems, Inc. BE LIABLE FOR COLLATERAL, CONSEQUENTIAL, INDIRECT OR INCIDENTAL DAMAGES ARISING OUT OF OR CONNECTED IN ANY WAY WITH THE TRANSACTIONS, WHICH ARE THE SUBJECT HEREFOF. L3 Systems, Inc. hereby notifies the Purchaser that L3 Systems, Inc. assumes no liability or responsibility resulting from failure or success of this device, as L3 Systems, Inc. is not responsible for nor has it approved or sanctioned Purchaser's final assembly. All warranties are void unless Purchaser obtains from L3 Systems, Inc. final user design and quality control testing.
  • Attorney's Fees
    In the event either party commences litigation to enforce or interpret this Agreement, the prevailing party shall be entitled to recover, in addition to all other items of recovery permitted by law, reasonable attorney's fees and costs incurred. The term "litigation" includes any proceedings involving arbitration or mediation.
  • Jurisdictions and Venue
    In any litigation arising hereunder or relating to any contract between Purchaser and L3 Systems, Inc., Purchaser hereby expressly submits to the jurisdiction of the Courts of the State of Washington, in King County, USA.
